Proposed Amendment To Lynn Township

Ordinance NO. 2008-1417

An ordinance of the township of Lynn, Lehigh County, amending the Lynn Township Zoning Ordinance to provide for the creation of the "volunteer firefighters relief overlay district" and for a purpose to be known as the "annual volunteer firefighters relief monetary boundary realignment"; to propagate peace, love, harmony among the two fire departments; to provide for fairness in monetary donations from Lynn township, to the two fire departments; to provide for the severability of provisions of the ordinance declared to be invalid; and to set the effective date of the ordinance.

WHEREAS, the Pennsylvania Municipalities Planning Code, as amended, confers upon the Board of Supervisors of the township the authority to amend, change, and/or modify its Zoning Ordinance within the township; and,

WHEREAS, the Board of Supervisors of the township of Lynn, recognize relief money is allocated by the state based on population, 50%, market value of real estate, 50%; and,

WHEREAS, the Board of Supervisors of the township of Lynn, recognize the current fire districts materialize a unfair disadvantage to district 17 because of the excessive growth in said district creating an unjust strain on the volunteers; and,

WHEREAS, the Board of Supervisors of the township of Lynn, seek to encourage a more efficient use of public services so that economies secured may be a benefit to all; and,

WHEREAS, the Board of Supervisors of the township of Lynn, wishes to foster an increased sense of community by providing a setting that encourages the natural intermingling of everyday activities within the two fire departments; and,

WHEREAS, the Board of Supervisors of the township of Lynn, following a public hearing duly noticed and advertised, has determined that the health, safety and general welfare of the citizens of Lynn will be promoted and served by establishing a "volunteer firefighters relief overlay district".

NOW, THEREFORE, be it ordained and enacted that the Lynn Township Zoning Ordinance is hereby amended to establish a "volunteer firefighters relief overlay district" and add the "annual volunteer firefighters relief monetary boundary realignment" a use permitted by right in the "volunteer firefighters relief overlay district"; and,

NOW, THEREFORE, the Zoning Officer shall, by the annual reorganization meeting of the Board of Supervisors of the township of Lynn, submit in writing, a current draft of the proposed "annual volunteer firefighters relief monetary boundary realignment", based on fifty percent population/fifty percent market value of real estate, such as to obtain much equality between the two departments; and,

NOW, THEREFORE, the "annual volunteer firefighters relief monetary boundary realignment" shall be contrived as not to strain the Lynn Township Sewer Plant nor the Northwestern Lehigh School District.

Severability, If a court of competent jurisdiction declares any provision of this Amendment to be invalid in whole or in part, the effect of such decision shall be limited to those provisions expressly stated in the decision to be invalid, and all other provisions of this Zoning Amendment shall continue to be separately and fully effective and shall not be affected by such invalidity.

Repealer, All provisions of Township ordinances and resolutions or parts thereof that were adopted prior to this Zoning Ordinance Amendment, and that are in conflict with this Zoning Ordinance Amendment are hereby repealed, including but not limited to, any conflicting provisions of the Lynn Township Zoning Ordinance of 1982, as amended.
